A Study On The Legal Security System Of Targeted Poverty Alleviation In Ecological Industry

In the report of the 19 th National Congress of the Communist Party of China,two strategies of ecological civilization and targeted poverty alleviation are determined.Only less than three years are left from current year to the year of 2020 when a moderately prosperous society will be built in an all-round way.At present,the construction has entered the sprint phase.Poverty alleviation in ecological industry can not only precisely alleviate poverty and reduce poverty,but also improve the ecological environment and achieve double harvest of social and ecological benefits.From the perspective of economic law,the unification of responsibility,authority,interest and benefit is the basic principle of economic law,which guides the implementation of targeted poverty alleviation in ecological industry.From the aspect of right,legal system endows related subjects with legal rights,but fails to balance and coordinate those rights,which results in some conflicts of rights in legal relationship on poverty alleviation.In terms of benefit,ecological benefits obtained from the process of targeted poverty alleviation in ecological industry are not significant.With regard to interest,improper treatment of interest relations is a serious problem in targeted poverty alleviation in ecological industry.Correspondingly,in the aspect of responsibility,during the process of targeted poverty alleviation in ecological industry,the problem that the responsibilities and functions of the government have not been harmonized is also quite prominent.Therefore,to solve those problems,it is necessary to strengthen ecological and environmental characteristics of targeted poverty alleviation in ecological industry through legal system and clarify the priority of legal rights for the development of ecological industry and the protection of ecological environment as well as handle the relationship between development and environment.In the meantime,the macro legal regulation of ecological economy and legal safeguard mechanism of ecological relief should be improved and regional ecological compensation legal mechanism should be established to guarantee basic interests and rights in targeted poverty alleviation in ecological industry.In view of various corruptions that may appear in the process of poverty alleviation in ecological industry,legal supervision mechanism should be improved and implemented strictly to crack down on corruption and control corruption.If above legal measures are improved,poverty alleviation system in ecological industry can be operated in a relatively stable environment,thus improving the implementation efficiency of poverty alleviation in ecological industry.In this way,poverty alleviation in ecological industry can truly overcome shortcomings,achieve the effect of poverty alleviation,protect ecological environment and achieve double harvest of social and ecological benefits.
