Research On Domain Name Registration And Protection

With the popularization of the Internet,goods and services have entered the virtual cyberspace from the real physical space,and e-commerce has mushroomed rapidly.Domain name is the premise and necessary condition for the enterprise to enter the network space,its commercial value is increasingly prominent.When the Internet becomes the main battlefield for commercial transactions and merchants to expand the brand power,the domain name has also evolved from a purely technical network address to a mark with important commercial value,which has resulted in a fierce collision and contradiction with the legal protection trademark in real life.As a new object of intellectual property,domain name is not perfect for its protection,and the difference between domain name and trademark also makes it impossible to link the domain name with trademark.The domain name registration as a trademark can realize the effective integration of domain name and trademark,thus the domain name is included in the protection scope of trademark law.Due to the technical characteristics of the domain name itself,the application for registration as a trademark still needs to meet certain conditions,and the domain name trademark is more complicated than the infringement problem in the common trademark.Based on the relationship between domain name and trademark,this paper discusses the requirements of domain name registration in trademark registration and the infringement of domain name trademark.
