The Main Problems And Legal Countermeasures Of Government Supervision In China's PPP Model

Public products and services are of great significance to the development of the country's social economy and the improvement of people's living standards.For a long time,public products and services are mainly provided by the government.However,in recent years,the debt of local governments has been high,and the problem of lack of construction funds has become increasingly apparent.In order to ease local government financial pressures,innovate economic development methods,and at the same time improve the quality and efficiency of the provision of public goods and services,the Chinese government has begun to vigorously promote the PPP(government and private capital cooperation)model.However,the short time for the promotion of the PPP model in China,and the corresponding supporting system is not perfect,especially the lack of government supervision,the proliferation of abuse of PPP model,and even the use of PPP disguised financing and other issues,hindered the development of the PPP model.Therefore,it is of great theoretical and practical significance to study the issue of government supervision in PPP mode.This paper uses the methods of literature induction and comparative analysis.It first introduces the basic concepts,main types,theoretical basis,and the importance of government supervision in the PPP model.Secondly,according to the current PPP laws and regulations in China as well as the status of government supervision,the main problems in the government supervision are analyzed.The Existence Problems of Government Supervision in China's PPP Mode at the Stage.Then the UK,the United States,and Singapore,which are the most typical of the PPP model,are selected to compare their government supervision models.Although these countries have different supervisory models,there are many successful experiences worthy of our country's reference.At last,the paper combines the relatively mature supervision mode in foreign countries and the main problems in the government supervision of PPP mode in China,and proposes the legal countermeasures for constructing the PPP government supervision system in China,which mainly includes:promptly formulating the PPP model government supervision legislation and ensuring that there are laws and regulations governing activities.Set up special supervision bodies to ensure the unity and independence of supervision power;Optimize the way of government supervision,introduce external supervision through information disclosure,and do a good job of linking internal supervision with external supervision;Improve judicial remedy for PPP disputes and fully guarantee the PPP model;Regulate the orderly and sustainable development and realize the maximization of public interests.
