On The Social Investigation Mechanism Of Judicial Social Workers Participating In Juvenile's Deliuquency

In 2012,the new Criminal Procedure Law formally established the social investigation system for juvenile criminal cases in China.Public security and judicial organs throughout the country are continuously applying this system.After the development of recent years,it has shown multiple aspects in the social investigation subjects of juvenile criminal cases.The characteristics of This article takes the subject of social investigation of juvenile criminal cases as the starting point,and discusses the necessity of judicial social workers to participate in the social investigation of juvenile criminal cases based on the development of changes in the social investigation subjects of juvenile criminal cases in China,in conjunction with the participation of judicial social workers.The actual operating mechanism of the social investigation of juvenile criminal cases analyzes the problems existing in the judicial social workers' participation in the social investigation of juvenile criminal cases and puts forward specific recommendations in an effort to further promote the participation of judicial social workers in the development of social investigations of juvenile criminal cases.The framework of this article is divided into five parts,focusing on the supporting foundation,operating mechanism,existing problems,and improvement measures for judicial social workers participating in the social investigation of juvenile criminal cases.The first part is the introduction,which mainly introduces the research background of judicial social workers participating in the social investigation of juvenile criminal cases,summarizes and summarizes the existing literature,and explains the research methods of this article.The second part is the supporting foundation for judicial social workers to participate in the social investigation of minor criminal cases.Firstly,the policy basis for judicial social workers to participate in the social investigation of juvenile criminal cases is introduced;secondly,the necessity for judicial social workers to participate in the social investigation of juvenile criminal cases,mainly combing the problems of other social subjects participating in the social investigation of juvenile criminal cases and judicial issues.Social workers participate in the criminal investigation of minors and take advantage of their own existing social surveys.The third part is the operating mechanism and effect of judicial social workers participating in the social investigation of juvenile criminal cases.The first is the involvement of judicial social workers in the initiation of social investigations;the second is the investigation mechanism of judicial social workers;the second is the writing of social investigation reports,with samples of social investigation reports written by judicial social workers,and the analysis of the role of social investigation reports;and finally judicial social workers.Participate in the effect of the social investigation report on minor criminal cases.The fourth part deals with the problems existing in the social investigation of juvenile criminal cases by judicial social workers.I have participated in judicial social workers on the ground to carry out the whole process of social investigation and analyzed the current social problems faced by judicial social workers in the social worker's own positioning,rights and obligations,personnel funding protection,information exchange,supervision mechanisms,and liability mechanisms.The fifth section proposes relevant improvement measures for the problems.This section aims to make targeted improvements in the issues involved in the social investigation of juvenile criminal cases by judicial social workers and put forward specific recommendations.
