| With flourishing of regional economic integration,more and more regional free trade agreements have been signed.Preferential duty is the most important part of the regional free trade agreement.Goods enjoying the preferential duty should be native to a specific region.The certificate of origin is a critically important way of origin certification.Compared with the certificate of origin,the declaration of origin has advantages,including a low administrative cost,convenience,quick acquisition,etc.These advantages are in line with the economic development trends of the current society.At present,the declaration of origin can mainly be divided into two models,namely North American model and pan-European model.Under each model,the declaration of certificate has its own characteristics.By comparing China’ s free trade agreement(FTA)with the North American model and pan-European model,this paper explores the rules of the declaration of origin suitable for China’ s national conditions.To start with,this paper analyzes and summarizes legal issues concerning the declaration of origin.Following that,the similarities and differences of the origin declaration rules of the regional FTA under the North American model and the pan-European model are analyzed and compared.Their advantages and disadvantages are pointed out,respectively.Finally,combining China ’ s current clauses for the declaration of origin and the advantages and disadvantages of different origin declaration rules,this paper puts forward feasible suggestions for the declaration of origin in FTAs to be signed by China. |
