Beginning with the 90's of 20th century,regional trade arrangements advanced considerably around the world,which make a profound impact on the prospect of international trade.Meanwhile,as a instrument of trade policy,rules of origin has been widely used in various regional trade arrangements,which plays a very important role in the development of regional trade arrangements,and receives more and more attentions,at the respect of preventing "trade deflection",promoting the development of trades in the area,or guiding the flow of foreign investments,introducing the high-tech,and adjusting the industrial structure. Nowadays,China is taking part in the building of the regional trade arrangements actively,and making it as an important strategic choice in the process of economic globalization.Therefore,strengthening the study of rules of origin in regional trade arrangements has a significant meaning in practice.However,China has relatively lagged in making the rules of origin in regional trade arrangements that we have involved in,mainly due to our late steps in participating in regional trade arrangements,and the limitation of legislation experience,having no choice but to accept the propositions of other partners.In that case,it is necessary to research and refer the advanced experience of the other countries or regions,at the aspects of participating in regional trade arrangements,formulating rules of origin,and to combine with the actual situation of our economic and trade development, making a set of rules of origin which conforms to the trade policy and benefit demands,to improve the development of our regional trade arrangements,to enhance the international competitiveness of our country.The writing of this paper is rightly based on this stay point.This paper has four parts,more than 30,000 words,through the methods of theory with practice,comparative analysis and text interpretation,etc,systematically elaborating the rules of origin in regional trade arrangements.The first part,regional trade arrangements and rules of origin.This part from the point that regional trade arrangements has became a apparent tendency in the process of international trade,while the rules of origin play an important role in regional trade arrangements,analyzing the function and character of the rules of origin in regional trade arrangements,coming to a conclusion that rules of origin has become the inherent rules in regional trade arrangements,without the rules of origin,regional trade arrangements will lose the meaning of existence.The second part,application standard of rules of origin in regional trade arrangements. This part is to introduce the core elements of rules of origin in regional trade arrangements, that is the application standard of rules of origin,which was divided into two parts, normal-standard and additional-standard.According to the analysis and comparison between the "Criterion of change of Tariff Classification","Criterion of ad Valorem Percentage", "'Criterion of Manufacturing Processing Operation",and elaborating the function of the additional standard,such as "Cumulation Rules","Tolerance Rules","Straight Transport Rules",etc,pointing out that the relax or strict,the simple or complicated to the standard is very important to the function of rules of origin in regional trade arrangements.The third part,the development model of rules of origin in regional trade arrangements. This part is to discuss the two kinds of leading models in the process of rules of origin in regional trade arrangements,that is "PAN-EURO Model" and "NAFTA Model",including the causes of their development and the interpretation of their contents,according to the analysis and comparison between them,extracting the advanced legislation experience from them, given our enlightenment at the aspects of laying down the rules of origin,in the process of participating in regional trade arrangements in the future.Lastly,pointing out that China should conform to the trend of the times and actively participate in building the regional trade arrangements,and lay down rules of origin in lined with our actual situation and benefit demands.By means of the study on the current legislation of rules of origin in regional trade arrangements that our country have been involved in,looking for the shortage in this field,and putting forward the corresponding countermeasures and suggestions to improve it,including laying down the harmonious and integrate rules of origin,building scientific system of identify standard of rules of origin.
