“Industry 4.0” was firstly introduced at the Hannover Messe in Germany in 2013 and was quickly embraced by the German government,companies,and research institutions.“Industry 4.0”,enabling automation and data exchange in manufacturing technology,is commonly referred to as the fourth industry revolution.In light of this concept,the Chinese government also released the “Made in China 2025” plan in 2015.Intellectual property is the most critical element in the era of “Industry 4.0”.As manufacturing industry will rely on digital software and Internet of Things to transform the production mode into customization.,intellectual property related legal issues tend to arise.At current stage,manufacturing industry in China is mainly resource-intensive and labor-intensive.The products have relatively small added value therefore the profitability margin of enterprises is low.In the “Industry 4.0” era,it is important for manufacturing industry upgrade its technology to enhance its global competitiveness.In this article,the characteristics of intellectual property protection in the era of “Industry 4.0” is discussed from the perspective of digitization,networking and customization.In particular,the protection of intellectual property in software,Internet of things and customized production has been analyzed.Moreover,after comparing intellectual property protection between foreign country and China,a systematic analysis of the new intellectual property problems caused by the current trend of the manufacturing industry in “Industrial 4.0” is conducted.Finally,for the protection of Internet intellectual property rights,this paper puts forward a suggestions,from the macroscopic perspective of government departments,to increase guidance and encouragement from the government departments,consummates the proposal of patent law by prohibiting the abuse of patent rights,improving the plea system of patent abuse,the reasonable use of patent rights and the compulsory licensing system and to standardize technical standards and intellectual property monopoly,to stop the abuse of intellectual property rights to eliminate or limit competition behavior to improve the “anti-monopoly law” recommendations.In the aspect of the protection of intellectual property rights in customized production,some suggestions are put forward to improve Intellectual property system and to protect the user’s participation in the customization of intellectual property.Through research,we hope to provide insight on the solution of intellectual property protection issues in the context of “Industry 4.0” and to create a better legal environment for the implementation and development of “Made in China 2025”.
