With the development of the entire big data industry,the Internet of Things technology is also booming.Internet of Things devices are increasingly integrated into people's daily lives,such as wearable devices,smart transportation,smart medical care,smart home,smart retail,etc.From small personal life to industrial management,the Internet of Things will Everything is connected to provide people with a service platform for data collection and management.While the Internet of Things technology facilitates people's lives,it also brings certain legal issues.The most worthy of consideration is the protection of personal information.Discussing the protection of personal information in the field of big data technology is not new,but because these problems have not been effectively solved so far,the author believes that it is worth further discussion.What's more,the Internet of Things technology also has its own characteristics,the most prominent point is that the Internet of Things intelligent products are closely connected with people.This characteristic determines that this technology will cause a new round of impact on the protection of personal information.In order to discuss in detail,the author starts with the Internet of Things(IOT)intelligent software and analyzes the infringement and remedies of the Internet of Things on personal information rights from the perspective of the combination of technology and law.In order to illustrate the impact of the Internet of Things on personal information and the legal challenges in the era of big data,the author points out a series of practical problems caused by IOT intelligent software infringing personal information,and with the help of the collection,use,storage and loss of personal information The four links,combined with the application of Internet of Things in health sports,explain how people's personal information rights are violated in this process.At the same time,the author pointed out the current situation and inadequacies of the legal regulation of the Internet of Things in China in terms of the protection of personal information and the Internet of Things.Combining with domestic and foreign legal regulations on personal information and the Internet of Things,the author puts forward some suggestions on how to use laws to regulate the Internet of Things.First,from the perspective of the Internet of Things industry,the scope of personal information should be clarified,clear regulations should be made at the stages of information collection,storage and processing,and the technical characteristics of the Internet of Things should be unified to unify the technical standards for safety in the industry,Clarify the relevant obligations and responsibilities of enterprises,strengthen industry self-discipline,and fully protect consumer personal information.Second,it is necessary to coordinate with various agencies,intervene in the protection of personal information beforehand,and flexibly deal with infringement issues through enhanced coordination afterw2rds,and severely pursue responsibility.This may require guiding laws to make procedural provisions.Third,provide guidance to individual consumers so that they are fully aware of their infringement of rights and establish awareness of rights protection,and remain vigilant against infringement of Internet of Things products.This article wants to discuss how the Internet of Things infringes the right of personal information on the basis of the Internet of Things intelligent software,and we change the question of how to protect it.The highlight of this article is:it distinguishes the difference between the infringement of the Internet of Things on personal information and the infringement of traditional technology;with the help of the theory of personal information,we propose a value stand for legal protection;Networked legal regulations require more technical discourse and more collaboration among social actors.
