Study On The Governmental Management Of Prison Enterprises

Prisons are the punishment organs of the state and bear the task of punishing and reforming criminals.They play an important role in maintaining public order and promoting social harmony.With the innovation of the prison system,prisons in China have formed two systems of education reform and prison economy,but even so,prison enterprises still expose many defects in the development process.First,the prison enterprises did not fully exert their economic effects,which can not guarantee the operating expenses of the prisons at all.Secondly,driven by the interests of prisons and the changes in the prison pattern,functional dislocations have emerged,thereby losing their social responsibility to a certain extent.Thirdly,as the prison enterprises themselves Due to the limited development,prisoners in prisons can not be provided with suitable and sufficient posts.This is not conducive to the dual role of prison enterprises in social and economic development.This paper mainly discusses the functions of the government in the process of the operation and development of the prison enterprises in Shaanxi Province.It will mainly adopt the methods of literature analysis,investigation and research analysis,and comparative analysis.Taking the basic background of the separation of prison & enterprise and the innovation of prison management system as the starting point,and combining with the practice of prison enterprise management in Shaanxi Province,this paper systematically combs the present situation of the operation of the prison enterprises in Shaanxi Province.Targeting problems including the difficulty of the current government management to balance the economic and social functions between the enterprises and the public,the difficulty of the public financial resources to play a promoting role,the excessive intervening of the government in the economic field,lack of high level government management and technical personnel and other problems,this paper analyzes the reasons why it is difficult for the government to exert the management function to the prison enterprises effectively: the dual function positioning of prison enterprises by the government does not conform to the actual situation,the financial service mechanism is not sound,there is the absence and bypassing the immediate leadership phenomenon in government functions,and the government lacks a sound employment mechanism.Based on the analysis of the causes of the government management which caused the development of the prison enterprise,this study insisted on the problem-orientation,looked for the solution through the reason,comprehensively used the representative governments of the developed countries in the administration of the United States,Germany,Australia and Canada practice,with a view to providing constructive help for the management of prison enterprises in our country.Through the analysis and study of the prison enterprises in the above four countries,we come to the following experiences: In order to achieve good development,the prison enterprises must clearly define the responsibilities of the prison enterprises,and must strengthen the construction of the prison enterprises.We must ensure that the running funds of the prison are plentiful.We must introduce social resources to broaden the field of prison enterprise development.Finally,this paper puts forward the countermeasures of strengthening the government management of the prison enterprises in China under the background of separating prison with enterprises from four aspects: to further clarify the nature of prison enterprises,to build a new prison funding security system,to find the correct functional positioning of the government in the prison enterprise management,and improve the prison enterprise employment mechanism.The points of view and suggestions put forward in this study have pertinence and maneuverability,providing the direction of government management in the operation of prison enterprises.
