Study On Civil Indirect Enforcement System

The study of civil indirect enforcement system is of great significance to improve our civil enforcement system and protect the interests of creditors.Through the system of indirect enforcement of civil rights,social contradictions can be solved in time,and the interests of creditors can be maintained,and social justice can be increased to a greater extent.At the same time,but also can enhance the authority of the law of our country in the legal level.Starting from the theoretical analysis of the system of civil indirect enforcement,this paper makes clear the meaning,characteristics,functions and basic principles of the system of civil indirect enforcement,and analyzes the current situation and existing problems of the system of civil indirect enforcement in our country.,such as,there is no unified guiding ideology,decentralized legislation,deterrence and imperfect supporting system.Specifically,at the present stage of China's regulations on civil indirect enforcement,and did not establish a separate law and relevant guidance rules,not only that,on the civil indirect enforcement system the concept of compulsory,has not been recognized by the public at the same time,indirect civil enforcement system in the implementation stage,the related means relatively few.So in this paper,for these problems from the angle of legislation,the specific angle of local protection and the court's own work and personal quality analysis of the specific cause of the last.After examining the system of foreign civil indirect enforcement,combining with the legal and social reality of our country,it is believed that the civil indirect execution legislation of our country should be perfected,the guiding ideology and principles of civil indirect enforcement in our country should be established,the feasibility of the civil indirect enforcement should be strengthened and the relevant supporting system should be perfected.
