Research On The Legal System Of Lottery Public Welfare Fund In China

The lottery public welfare fund is a kind of government fund that is based on the issue of lottery and devotes itself to the development of social public welfare undertakings in our country.It is different from the government's tax and administrative fees,and it realizes the third distribution of social wealth.It is an important financial income.In recent years,the problems of lottery public welfare fund frequently occur,such as the misappropriation of the public welfare fund and other malignant events.The legal system of lottery public welfare fund needs improvement.The gradual increase in the amount of lottery public welfare fund has aroused the public's concern about its reasonable utilization level.Based on the existing laws and regulations,it should find out the loopholes in this system and put forward effective measures for improvement so as to achieve the rational use of lottery public welfare fund,and promote the development of public welfare in our country.This article studies the current system of lottery public welfare fund and attempts to improve the current system to promote the effective use of lottery public welfare fund.This article is divided into four parts.The first part introduces the basic theory of lottery public welfare fund and analyzes its legal characteristics,such as the public welfare revenue,social nature and public welfare.It is based on the public product theory,the social distribution theory and the state intervention theory.The second part studies the management and use mode of foreign lottery public welfare fund and analyzes the relevant norms of the legal system of it in France,Britain and the United States,refines its management and operation mode with national monopoly business,distributive mechanism of lottery public welfare allocated separately,and the independence and validity of lottery public welfare supervision institution.The third part first illustrates some typical legal norms.After introducing the present situation of the lottery public welfare fund in our country,it analyzes the existing problems in our current system from the aspects of management,distribution,use and supervision.The fourth part is to put forward the corresponding suggestions for the above problems.In terms of management,the existing administrative system in our country should be perfected.On thedistributional basis,we should optimize the existing distribution mechanism by implementing the national overall plan,clarifying the distribution ratio of social security funds and optimizing method of budget.In the use of the lottery,the whole process of using the lottery public welfare fund should set up a procedural standard;Finally,the external supervision mechanism of the lottery public welfare fund should be perfected.
