China's insurance is developing rapidly.The data show that insurance premium income has grown rapidly in the last five years,and the average annual growth rate of premium income of individual insurance companies is about 20%.But high speed growth also brings problems.Misleading sales,fraud,exclusions and other behavior frequently appear in public view.The insurance law and other related laws are still weak in the protection of the insured in some cases.And foreign insurance industry laws and regulations and industry norms are more mature.By drawing on the advanced experience and ideas of foreign laws and practices,we can enhance the protection of the insured and play a positive role in standardizing the development of China's insurance industry.And the principle of reasonable expectation in the European and American law system is one of them.The first part of the article introduces the concept of the principle of rational expectation and the history of its development.The second part will then show each version and give an example of its application.The third part of the thesis is the reasonable expectation of the principle of moral risk,to stimulate the insurance companies,to reduce the three major drawbacks of the judicial authority.The fourth part explains in detail the restriction of the principle of reasonable expectation from three aspects:the limitation on the judge,the limitation on the subject of the contract and the restriction on the terms.The fifth part of the introduction of the legislative,judicial,social level of three aspects of the introduction of the principle of reasonable expectation.It is expected that this principle can be applied at home in the future,and can reach its original intention to make some theoretical reference.
