The Causes Of The Frequent Violence Enforcement Of Chengguan In China And Its Elimination Path

With the development of cities,the importance of city management has become increasingly prominent.Chengguan's law enforcement is the main object of the government's urban management,and plays an important role in the process of achieving “better city life”.However,violent law-enforcement activities that occurred in Chengguan's law enforcement agencies have often been staged in urban streets.Urban management has gradually evolved into a tug-of-war between law enforcement and street vendors.This is inconsistent with the rule of law and the construction of a harmonious society,and also reduce government credibility.In recent years,the reform of urban management and law enforcement has been continuously implemented,but none of them has eliminated violence.This proves that we still do not have a profound understanding of the causes of violent law enforcement in urban management and we have not found an effective governance path.Embedded law enforcement believes that any law enforcement activity will not be carried out in isolation,but embedded in a certain social background,institutional environment,and specific law enforcement space.The specific law enforcement actions of law enforcement officers are deeply affected by the three.Based on this theory,this paper finds that the high-speed urbanization,multi-target groups of chengguan's law enforcement,and the marginality of “street vendor economy” are the complex social backgrounds of urban management law enforcement;At the institutional level,the bias of the government's urban management concept and pressure-type system are the direct cause of chengguan's violent law enforcement;the street law enforcement contest is an accidental factor that triggers chengguan's violent law enforcement.On this basis,it proposes an effective way to eliminate violent law enforcement: at the social level,it must improve the social security system for disadvantaged groups,cultivate self-government organizations for commerce and trade,and strengthen public participation,so as to reduce the burden on chengguan's law enforcement;at the institutional level,the government needs to establish a“people-oriented” urban management concept,breaks the path dependence of the pressure-type system and shifts to conventional governance;at the specific level of law enforcement,it is necessary to strengthen the administrative technical training of frontline law enforcement personnel,strengthen dialogue and communication with law enforcement objects,and seek public recognition to reduce the difficulty of streetlaw enforcement.
