Dissertation On The Problem Of Violence Against Local Administrative Law Enforcement

The administrative law enforcement of city management is the focus of the work of the Government in recent years in our country.It is an effect of government institutions' reforms and face-to-face contact with local people,with a focus on solving a variety of problem that citizen may occur in everyday life.Therefore,research on the problem of violence against the law enforcement is an urgent topic.This paper adopts empirical analysis method,interviews,case analyses and literature research,studying the roots,development,achievements and difficulties of modern urban management,deeply analyzing typical characteristics of Lucheng district of Wenzhou that Comprehensive Administrative Law Enforcement Bureau encountered.Starting from the current situation of Lucheng district of Wenzhou urban management and law enforcement,the paper addresses negative impacts on the victims,on the officers,on the perpetrators and therefore on the society as whole.This paper argues that the reasons of violence against law can be clustered into three categories,i.e.the subject of law enforcement,law enforcement process and law enforcement environment.In detail,the specific reasons are: the average quality of citizens is not high,the lack of experience,lack of capacity.Often,resistance against law enforcement is due to lack of legal awareness.This lack of legal knowledge and ignorance against the law restrains leads people to protect their own interest regardless of regulations.Moreover,some social reasons can also be detected,such as lack of rigorous enforcement from officers' side,a shortage of protection given by public services,the negative influence of public opinion and so on.To conclude,this paper proposes that law enforcement should be changed starting from a flexible enforcement rather than rigid application,combined with appropriate information for public,active learning,practical hard-work in field,scientific top management.To strengthen the assessment one needs,from one hand,a clear awareness of law objective as a legal solution and protection for citizens,rather than for the sake of pecuniary fines;on the other hand,a solid legal education of citizens and incentive to encourage the public to participate in the work of supervision and management in urban management.At the same time,measures at higher level should take place,such as a review of law enforcement departments of the system and its linkage mechanism,comprehensive law enforcement,improvement of social security assistance and positive refinement of public opinion.Finally,I hope the government can establish a new concept of urban management,paying attention to people's livelihood,highlighting disadvantaged groups,but also bearing in mind to safeguard the safety of law enforcement personnel,building a more livable and human Wenzhou,making a more harmonious society.
