Research On Criminal Law Regulation Of Internet Violence

Under the background of the new era,the rapid development of the Internet is inseparable from people' s life,and has become the second living space of people's daily interpersonal communication.Internet order is also a kind of public order.Internet violence seriously affects and destroys the order of cyberspace,and internet violence also violates the personal rights of the parties,such as privacy and reputation.At present,because our civil law and administrative law do not regulate the behavior of network violence,and the illegal cost is low,and Internet users' legal awareness is weak,they can not play a good deterrent and regulate the role of internet violence.As a result,the network of violence is becoming more and more intense,so it is urgent to improve the legal system and play the role of the legal norms of the criminal law.At present,the criminal law regulation of network defamation mainly includes the criminal law,the amendment of criminal law and the judicial interpretation.The criminal law stipulates the constitutive requirements of network defamation and the crime of disclosing personal information.The criminal law amendment nine specifically stipulates the problem of obtaining evidence for network defamation.However,there is a lack of a clear definition of the term internet violence in the criminal law,and the use of other charges for the regulation of internet violence.Based on the concept of network violence,manifestations,behavioral subjects,the analysis of network criminal law in foreign countries and the existing problems of internet violence in China,this paper puts forward some suggestions on the regulation of internet violence.
