Research On Legal System Of Emission Trading Pilot

Emissions trading is under total control,which enables polluters to buy or sell emission permits through market mechanism,so as to achieve incentive and initiative pollution control,so as to effectively control pollution and improve environmental quality.The system originated in the US in the 70s and has been fully practiced in developed countries.It has proved that the emission trading system is the trend of environmental policy and the innovation of environmental law.Our country started the pilot project of emission permits in the early 90s.Today,the emissions trading system has been developed rapidly and profoundly implemented.In some places,a more systematic management and implementation rules of emissions trading have been formulated.The academic circle has also done a lot of research on emission trading.However,as an emissions trading system originated in Anglo American law system,there are conflicts in many places and the existing legal system of our country.In practice,there are also various problems.Based on the normative documents of the emission rights of Hunan Province,the author discusses the pollutant emission trading system in a more comprehensive way and focuses on the establishment of the emission trading system in the representative central pilot province of Hunan Province,analyzes its advantages and disadvantages,and puts forward the improvement of the legislative level and the improvement of the initial confounding in combination with the actual situation in China.We should envisage the implementation of total quantity control and pay attention to the design of the two level market system.
