Third-Party Interventions In Petition Work

With the acceleration of social transformation in our country and the increasing awareness of rights protection of the masses,Letters and visits,a mechanism for resolving social conflicts with Chinese characteristics,have received increasing attention from the society.Letters and visits,as an institutionalized mechanism to resolve social contradictions,on the one hand,play a role in resolving social contradictions and solving social problems.On the other hand,they are facing difficulties and paradoxes.The endless number of cases of petitions and unstoppable petitioners consume a lot of governance resources,but it is difficult to get effective and complete governance,and petition work is often deadlocked.The third party's intervention provided new ideas for the petition work.The involvement of third parties in petition work has increasingly become a research topic for researchers,and the petition departments at various levels have increasingly tried to use third-party forces to resolve petition conflicts.Currently,in academia,the research and practice of third-party involvement in petition work remain at the theoretical level.They mainly focus on analyzing feasibility and advantages,and they lack sufficient attention to how to implement and work mechanisms.This article takes the X city petition work expert think-tank association as an example,using qualitative research methods,and discusses the current status,motivation,methods,mechanisms,and scope of application of third-party intervention petition work.This paper analyzes the effectiveness,dilemma and enlightenment of third-party intervention in petition work by enumerating specific cases of petition issues such as historical issues,Land acquisition and relocation,social security and medical disputes.Through research,we hope to bring new ideas for the current third-party intervention in petition work,so that more petition problems can be solved and more petitioners can be benefited.The study found that the establishment of X City's petition work expert think-tank association was in line with the development of the times.It was established by the X City Letters and Visits Bureau in combination with its actual use of urban governance resources.This social organization must not only resolve the contradictions of petition as a third party force,but also play its role in providing advice,building a bridge of communication,providing decision-making advice,theoretical guidance,and social supervision.The organization uses its advantages of strong professionalism,sufficient neutrality,high authority,strong sense of responsibility,and strong manpower and platform support.In the seven years since its founding,the organization played a huge role in has resolved in conflict resolution,decision consultation,theoretical research and social supervision.However,at present,there are still three major problems in the third-party involvement in petition work.First,there is a lack of legal institutional guarantees and strong government support.Second,third party has no administrative power and limited experts' energy as well as lacking of autonomy.The last problem is the plight of letters and visits.The accumulation of letters and visits and the petitioning of old households have added great difficulty to the dissolution of the petition.Based on this,this study proposes four suggestions:First,start with the law and improve the law to provide protection.Second,change the concept of government and scientifically positioning third parties.Third,improve the working mechanism and increase publicity.Fourth,strengthen the third party's own power and better resolve social conflicts.
