Study On Internet Broadcasting Rights In Sports Events

With continuously developing the network technology,"Internet +sports" has gradually integrated into our daily life.Based on the audience's demand,the internet broadcasting in sports events has gradually become prosperous.After the State Council promulgated Several Opinions on Accelerating the Development of Sports Industry and Promoting Sports Consumption in 2014,the internet broadcasting of sports events in China has shown a momentum of development.In this process,various contradictions and disputes have emerged one after another,which has led to a heated discussion on internet broadcasting rights in sports events.As far as the legal attributes of the internet broadcasting rights in sports events are concerned,most of them are classified in the form of legislation in the category of intellectual property rights,and they are also identified as copyrights or neighboring rights according to different legal systems.However,the legal nature of statutory law on the sports events'internet broadcasting rights in China has not been clarified.There has been a lot of disagreement among scholars on the nature of the rights in sports events.The judiciary's practice community is also arguing that the relevant cases of the internet broadcasting rights disputes in sports events are not consistent.In view of the fact that contradictions and disputes in the broadcasting in sports events are prone to multiple occurrences and different judgments are made in the same case,in order to promote its standardized operation,it is necessary to distinguish the rights attribute and rights structure of the internet broadcasting rights in sports events from those of broadcasting organizations.The right to disseminate information on the Internet has been clearly defined and its rights have been established through legislation.To protect the internet broadcasting rights in sports events,first of all,we can start from the legislative level,expand the extension of "works" in China's "copyright law",include the sports event programs in the scope of works,and clearly define the legal rights of broadcasting rights in sports events in the neighboring rights.Secondly,"Three-Step Law" need to be established at the judicial level,and the Intellectual Property Case Guidance Library can be improved in judicial practice.Finally,strengthen law enforcement and supervision in the law enforcement level,perfect the supervision mechanism through legislation,to prevent and crack down on Internet theft behavior,and increase the propaganda education of intellectual property,and cultivate the benign atmosphere of intellectual property rights protection.A special protection system should be established for the network broadcast of sports events to guarantee the benign communication environment,so as to ensure the steady development of the emerging cultural industry in the market economy.
