Research On Prevent Bio Piracy International Studies—The "Convention On Biological Diversity" System As The Breakthrough Point

With the continuous advancement of biotechnology in the world,biotechnology is trying to change each passing day.The world resource model also follows the development trend of biotechnology.The original resources for economic development are substituted for traditional fossil fuel resources and metal mineral resources by biological genetic resources.In view of the importance of biological genetic resources in the new era and the depletion of various traditional primitive resources,more and more countries have shifted the focus of national development to the progress of biological genetic resources and their biotechnology.However,apart from Australia,the 12 countries with the most abundant biodiversity are all developing countries in the geographical distribution of biological genetic resources.Therefore,on the one hand,developed countries with advanced biotechnology and rich development funds have relatively scarce biological genetic resources,and on the other hand,developing countries with rich biological genetic resources but lagging behind biotechnology and lacking development funds have coexisted with such contradictions.In the case that the international bio-regrets resource conservation regulation is not relatively imperfect,without knowing the community where the genetic resources are located and without any consensus,the predatory development of the biological resources and local traditional knowledge of the victimized country has caused the affected countries to suffer huge loss.In this context,how to avoid the international phenomenon of bio piracy has become the focus of attention of the international community.This article will review the issues of the CBD system and its access and benefit-sharing measures to prevent bio piracy and the measures of the TRIPs agreement to prevent the phenomenon of bio piracy,and explore the implications of these measures for our country in improving the prevention of bio piracy in the legal regulations.In the first part of this paper,the concept and definition of biological plagiarism are introduced through the introduction of a case of biopics plagiarizing in India.The hard consequences of combining biological plagiarism cause by bio piracy.In the second part of this paper,we will study the law reason of bio piracy.In the third part of this paper,we will study the system of CBD and its ABS to discuss specific measures to avoid bio piracy.In the fourth part of the paper,on the basis of the TRIPs agreement,this paper discusses how to prevent bio piracy.The fifth part of the paper,combined with the contents of the above-mentioned content and the protection status of China's biological genetic resources and traditional knowledge,analyzes in the "CBD" system,discusses the specific measures to prevent biological plagiarism and causes reflection on the prevention of biological plagiarism in China.
