Artificial intelligence is unprecedentedly improving and upgrading our economic and societal life.With the rapid development of scientific technology,more and more legal issues have emerged under the personification imagination to artificial intelligence entities.In the view of current discussions on tort law,patent law,product responsibility law,all legal arguments associated with artificial intelligence entities would yield to one original question that should an artificial intelligence entity be granted legal personhood?Imaginably,artificial intelligence entities will probably play key roles in companion with human beings in the future.Since that,the contemporary legal system should give a determinative answer to the popular.According to its innate concept characteristics,legal personhood is believed to be categorized into public and private law spheres.Given that constitutional personhood is derived from the legal personhood,therefore,in this paper,the private sphere of legal personhood is focused mostly in order that the subsequent constitutional studies on artificial intelligence could follow the proposed opinions.There are four chapters in this essay.In the first chapter,the concept history of person is reviewed and its fictitious practices are focused as well.In the second chapter,legal issues that the legal system is facing are depicted under the context of the wide application of artificial intelligence.In the third chapter,two schools of thoughts on the personhood of artificial intelligence are introduced.After summarizing the previous thoughts,the quasi-personhood artificial intelligence entities is discussed by analogy reasoning with animals(especially with pet).This advice,on one hand could protect our human moral values and on the other hand provide starting point to resolve the current legal puzzles.Based on that,in the fourth part,discussed are two questions that could an artificial intelligence entity be a lawful trustee and how to properly use artificial intelligence entities.
