With the changing each passing day of Scientific technology,artificial intelligence was born and continued to progress.New technology greatly facilitates our life,at the same time,it also brings a lot of trouble,results lots of legal problems,and leds to a wide range of discussions,Among which,scholars have a particularly heated discussion on the legal status of artificial intelligence.What positivism think is giving the legal subject status to artificial intelligence is not only an effective means to solve its tort liability,but also a reasonable choice to cater to its future development;Eclecticism is more affirmed about artificial intelligence`s particularity than its instrumentality,and it is not impossible to endow artificial intelligence limited personality;Negativism holds that we should adhere to the object status of artificial intelligence unswervingly for the essence of artificial intelligence.Law is a tool to serve human beings,showing the value estimations of human beings.There is a deep value consideration behind the fact that the law chooses who can be the legal subject from its picky point of view.Artificial intelligence does not have rationality,can not meet the standard of the status of legal subject of natural person,;artificial intelligence also lacks considerable social value,which makes it can not imitate corporate organization to obtain the qualification of legal subject.On the contrary,maintaining humility to treat artificial intelligence as the object of law is not only the realistic consideration of the development of artificial intelligence technology,the basic need of the normal operation of the current legal system,but also the inevitable requirement of insisting on humanitarianism.
