Research On The Civil Legal Status Of Artificial Intelligence

With the continuous improvement of the learning ability of artificial intelligence,there have been infringement cases of artificial intelligence such as self-driving cars hitting people,which have posed a big problem for the definition of a liability in the judicial practice of our country.To discuss the legal status of artificial intelligence is the premise to study whether artificial intelligence can own the copyright and bear the civil liability independently,and it is the key to solving the ethical and legal problems caused by artificial intelligence.To solve the existing and potential legal risks of artificial intelligence and fulfill the legal gaps in cases concerning artificial intelligence,it is urgent to clarify the legal status of artificial intelligence.Due to the difference in artificial intelligence,we should analyze the legal problems brought by artificial intelligence in different stages from different angles.Weak AI does not have independent consciousness ability,but in some ways can take the place of human social activities.Strong AI has the independent ability of intention and wisdom to think,but now we knew little about it.A few scholars believe that the qualification of AI agents as subjects of civil legal relations should be recognized.Based on the country's vigorous promotion of 5G development,we should be more open to the legal status of AI,affirm the principal status of AI agents and make AI the independent subject of responsibility,which is the most direct and effective way to solve the infringement of AI.More scholars are opposed to this.The civil subject status of weak artificial intelligence violates the idea that the subject and object of civil law are not interchangeable,and when it is not known whether strong artificial intelligence can be realized,the discussion of institution construction is separated from the development status of artificial intelligence,which inevitably leads to the waste of academic resources.The author believes that artificial intelligence agent is a tool for human beings to transform the world.It is reasonable to grant artificial intelligence agents the qualification of civil law subject,but it will cause a great impact on the civil law structure foundation of China.Therefore,Artificial narrow intelligence has no capacity for civil conduct and civil rights,and cannot undertake responsibilities independently and fulfill obligations.So it should not be the subject of civil legal relations.How to study the legal status of artificial intelligence agents based on the current civil law in China is the first problem we should pay attention to in this kind of research,which requires us to conduct more exploration.
