Research On The Application Of Administrative Record

With the development of the research of administrative law,the concept of administrative service has gradually been established in the administration of all countries.Guided by the concept of service,our country regards the service-oriented government that builds the satisfaction of the people as an important part of the reform of the administrative system.However,the extensive use of our traditional administrative mode of administration does not meet the requirements of service-oriented government.The government needs to strengthen the innovation of administrative measures and promote the diversification of administrative modes.Administrative filing,as a kind of gentle administration,accords with the development of administrative service concept.From the beginning of the 21 st century,the government stepped up the remediation of administrative examination and approval items.In order to ensure the improvement of administrative efficiency and administrative quality,the government reduced the administrative means of administrative examination and approval.As a new type of administrative means,administrative filing is gradually being promoted.Due to the lack of research on administrative filing properties,there are many problems in the application of administrative filing.This article mainly discusses the properties of administrative filing.The full text is divided into five parts.The first part mainly analyzes the status quo of administrative filing,including the background of filing,the issue of filing and the narration of the status of theory.The second part is on the basis of the first part of the nature of the administrative filing,the main content is the definition of administrative filing attributes.This part respectively draws on the academic theories on the nature of the filing in the legislation and the nature of the foreign administrative filing.At the same time,it also analyzes the nature of the administrative filing from the perspective of the principle of administrative action,and discusses the traditional classification of administrative filing.The third part points out the problems existing in the formulation and application of administrative filing,including the non-standard issues such as the formulation of the main body and the scope of formulation,the misunderstanding of the nature of the filing during the application of administrative filing,and the inconsistency of the examination methods.The fourth part is about the solution of the third part of the problems arising from the proposed measures,including the main body and scope of the establishment of administrative records,the examination of unifiedadministrative filing,a reasonable definition of administrative records and post-supervision behavior boundaries.
