The current President of the People's Court has assumed multiple roles and multiple functions.First,the President of the People's Court,as a post judge,should participate in a collegiate bench or as a sole judge to hear the case.In this case,the role of the role played and its function is no different from ordinary judges.Second,the President of the People's Court must also assume responsibility for the macro-management of trials in the courts and effectively handle other administrative affairs of the court.At this time,the President of the People's Court acts as a leader and fully leads the people's courts.In the end,the people's courts are rooted in grassroots units and will inevitably have contact and communication with external party and government departments or other social groups,and will even have superior and inferior relations with the township party and government departments.In this sense,the President of the People's Court plays the role of a grass-roots official.Individuals playing multiple roles at the same time will inevitably lead to a certain predicament.For example,limitations on time and effort have led to the inability to fully fulfill all of the role requirements.At the same time,role-players themselves have different understandings of their roles,coupled with the restrictions imposed by external factors on their roles,and the role of practice can easily deviate from people's expectations.This article attempts to take the role of the President of the People's Court as a line to fully examine the functioning of its function.In addition to the introduction and conclusion,this article consists of five parts:The first part explains the origin and definition of the word role,and points out that when a certain social member occupies a certain social status,it means that he occupies a group of “character plexus”.The same is true of the President of the People's Court.In judicial practice,it actually played the role of judges,leaders,and officials.The second part mainly analyzes the plight of the role of the President of the People's Court,including the overloading of roles and the deviation of roles.Role overload refers to the role of the President of the People's Court at the same time.Limitations of time and effort make it difficult for the President of the People's Court to fulfill all the role requirements;the deviation of the role means that the role played by the President of the People's Court deviated from the provisions of the law,namely the role of practice.Separation from the role set by law.The third part mainly analyzes the deep motives of the role of the President of the People's Court,mainly in two aspects: first,the limitation of the independence of the judiciary,and the judiciary's right to judge the right is not a function of the judicial power in China's judicial process.To embody;Secondly,in our country's courts,the management model of copying administrative organs internally,judgmental affairs and administrative affairs are confused,resulting in the emergence of an administrative decision model for judicial decisions.The fourth part mainly discusses the influence of the predicament of the President of the People's Court.In the People's Court,it is mainly discussed in terms of judicial effects,the operation of judicial powers,and court management.Outside the People's Court,it discusses the expansion of its functions from the perspective of the external relations of the People's Court.The fifth part aims to find a way out for the plight of the President of the People's Court.The multiple roles played by the President of the People's Court have different degrees of importance.They should first play their most important roles,namely the role of judges,and reform the relevant systems of the President of the People's Court.
