Research On The Legislative Power And Its Execution Of The Municipal People's Congress

Content: The revised legislation law in 2015 empowers all "cities with districts" in China the local legislative power.It was a landmark event in the history as well as revolutionary significance in the process of social governance.In the face of this major change,this paper concentrates the issue in two aspects: one is to study the expansion of the legislation on the evolution and reasons for exploring the scope and limits of the legislative power with historical and comparative analysis method.Through analysis,we can find that on the one hand,our country greatly expanded the local legislation power.The extension did not violate the constitution.On the country,it met the real need of grassroots social governance in our country and deeply rooted in the need of social development.On the other hand,the expansion shall also have limitations,which is based on article seventy-third of "The legislative law".The most important issue turns to how to definite the legislative scope and restriction of Municipal People's Congress.The empirical research data indicates that there are kinds of difficulties in the process of the concrete exercise of the legislative power,which includes that the involved legislative item is relatively limited,the standardization needs to be improved and local characteristics is not obvious.All of problems are closely related to the shortage of talented local legislation persons,the unclear scope of legislative power between Municipal People's Congress and its permanent committee and lack of the unified understanding of nature as well as the standard of the Provincial People's Congress permanent committee "approving process".In one word,it is not reasonable to impede the possible positive influence of local legislative power.Frankly speaking,we and the whole society should continue encouraging various cities to make local laws within their respective legislation power,only by this way can we try to strive for the legislation practice to solve specific problems in practice when we strengthen originally interpret and the importance of Municipal People's Congress' legislation.
