Research On Problems And Countermeasures In The Operation Of Local Legislative Power In Districts

The third session of the Twelfth National People's Congress adopted the decision of the National People's Congress to amend the legislation law of the People's Republic of China.In March 11,2018,the amendment to the constitution of People's Republic of China passed the constitution of the local legislative power of the district into the constitution.So far,the status of the local legislation in the district has been the highest in history.But since the revision of the "legislative law" in 2015 to nearly three years,there is such a problem in the operation of the local legislative power in the District,which needs a positive look.To sum up,I think it is necessary to summarize the experience and discuss the problems in the operation of the legislative power in these districts,and put forward relevant countermeasures.The first part of the article deeply analyzes the municipal legal rights of the District,and elaborates the four aspects,including the concept,characteristics,basic principles and significance of the legislative power of the District,and makes a comprehensive analysis of the legislative power of the district.The basic principle of a districted city legislative power characteristics,range,characteristics,unity leads to local legislation should follow the principles: adhere to the leadership and party shall not contravene the principles and law,highlight the local characteristics,enhance the implementation of the principle of principle,fully respect the public principle.Then it introduces the significance of the local legislative power given to the city.The second part of the article introduces the problems existing in the operation of the local legislative power in the district.From "the local people's Congress has not realized its real value in the leading work of the legislative activities,the public's participation in the local legislation is insufficient,the legislative capacity needs to be promoted,the legislative procedure still needs to be improved,the supervision of the legislative power is not perfect,the quality of the legislature needs to be improved",and its shortcomings are explained in the following six aspects.The diameter is paving.The third part of the article aims at solving the shortcomings of the second parts,including the six aspects of the existence of "strengthening the role of the Municipal People's Congress in the legislative work,improving the public participation mechanism,strengthening the construction of legislative capacity,improving the legislative procedure,improving the legislative supervision system,and improving the quality of the municipal legislation in the establishment of the district." The question was put forward.
