Research On Housing Endowment Legal Problems

The housing endowment has been popular in western developed countries for many years.Which is an important supplement to old-age income.It's a good deal for older people with independent property rights in the western developed countries,The pattern is a good way to solve old people's problems.At present,China's aging rate is rising,and the elderly's pension problem is becoming more and more serious.Facing the increasing aging of Chinese cities and the real problems of family and social endowment pressure,The existing pension model cannot fully satisfy the material and spiritual pursuit of the elderly.Therefore,it is necessary to implement the third pension model to supplement the elderly's pension.In 2002,China introduced the concept of housing for the elderly.However,the promotion and implementation effect of China's "housing pension" is not ideal.Facing the severe test of population aging,How to solve the pension problem,Alleviating social and child stress,Therefore,it is worth our research to realize the real age.This is the entry point,To analyze the obstacles existing in the housing endowment in the perspective of law,On the basis of summarizing the operating mode and successful experience,To propose some legal advice for our country.First,the first part of the article is the legal basis of housing endowment.Based on the connotation and legal characteristics of housing endowment,this paper analyzes the legal relations and legal theoretical basis of the system.Second,The second part of the article describes the practice and problems of housing for the aged in China.This paper introduces the housing endowment policy launched by Shanghai,Beijing,nanjing,citic bank and happy life,and analyzes the reasons for its failure.On this basis,It sums up the problems that our country faces.Such as the traditional concept of constraints,imperfect legal supporting mechanisms,lack of government policy support and supervision,lack of reasonable procedures.Thirdly,The third part of the article compares the housing endowment in the United States and Taiwan,The home-based pension system in the United States and Taiwan and its successful experience are summarized.Finally,The fourth part of the article is to construct the legal thinking of housing endowment in China.This part is mainly from the establishment of the concept of housing for the aged,Clarify the issue of renewal of property rights.Clarify the provisions on reverse mortgage of real estate.Give full play to the important role of the government.Design a scientific operation mode of housing for the aged.Standardize the involvement of participating organizations.To improve the legal supervision system of housing endowment and other aspects of the establishment of China's housing endowment system legal countermeasures.
