With the continuous development of artificial intelligence,the United States,Germany,Japan and other countries have taken the lead in research and development of self-driving cars and issued corresponding policies and regulations.In China,only Beijing and Shanghai have issued guidance on self-driving cars.With the development of science and technology,self-driving cars will gradually be integrated into the daily lives of the people of our country.However,with regard to China's current tort law,its current regulations are difficult to adapt to the above trends,and will inevitably lead to the regulation of auto-driving car-harm behaviors.Unable to follow.Therefore,this article intends to start with the definition of self-driving cars,analyze their challenges to our country's tort law,and examine the foreign tort laws and regulations on the auto-driving car tort,and put forward our country's tort law on the auto-driving car harm to improve the way.The full text is divided into four parts:The first part is the definition of a self-driving car.This paper analyzes the concept of self-driving cars and draws on the concept definition of self-driving cars in the guidance of road tests for self-driving cars in Beijing and Shanghai,and considers that self-driving cars should be defined as an algorithm-based one.The combination of auto mechanical hardware system and auto-pilot system software system to achieve human-specific driving purposes of artificial intelligence,including conditional automation,highly automated,fully automated three categories.The second part is the challenge of self-driving car injury to our country's tort law.This article studies the current special regulations on autonomous driving vehicles in China and the relevant provisions of China's Tort Law on the harm caused by self-driving cars.It states that the infringement laws and regulations of auto-driving cars in China have the following deficiencies:The main body of self-driving cars.It is difficult to recognize qualifications,it is difficult to determine the nature of violations,and it is difficult to determine cause and effect relationships.Fault tort liability is difficult to apply.The third part is the investigation of the tort system of the harm caused by self-driving cars in foreign countries.This article compares the legislation of the United States,Germany,and Japan with auto-infringement vehicles and considers that the US and Japan regulations are more general.The German regulations are relatively detailed and practical.The legislation of auto-driving cars in China requires legislators to pay attention to the rationalization of the division of rights and responsibilities between the driver and the smart car in autonomous driving situations.The fourth part is the perfection of the tort law of auto-driving cars.This paper first defines the three laws of robots and the principles of technology neutrality as the tort rules of auto-driving cars.Secondly,the main causes of damage caused by self-driving cars are classified into self-driving car owners,self-driving car producers,and auto-driving car sellers.In the end,this paper discusses the ways in which the different subjects bear tort liability under the three conditions of conditional automation,highly automation and complete automation.
