In order to vigorously promote the development of self-driving cars,Germany,the United States,the United Kingdom and other countries have introduced policies to seize the peak of innovation and maintain its leading position in the field of scientific and technological innovation.In order to promote the development of self-driving cars,local governments in China have issued normative documents on the road test of self-driving cars in order to promote the development of self-driving technology,such as Beijing,Shanghai and other cities.With the continuous development of artificial intelligence,self-driving cars are getting closer and closer to us.We are no longer strangers to it.Intelligent cars in science fiction movies will become a reality in the near future.And the lag of laws often fails to meet the challenges brought by new technologies.According to the current development status of self-driving cars,they are not infallible.According to the existing news reports around the world,traffic accidents of self-driving cars are not just an isolated case.Although there is no case of infringement of self-driving cars in China,with the expansion of road test range of self-driving cars,self-driving cars will drive on the same road with traditional cars,pedestrians and non-motor vehicles,and traffic accidents may be found.However,according to the current situation of relevant legislation in China,it may not be able to deal with the challenges brought by the infringement of self-driving cars.Therefore,this paper intends to start with the definition of self-driving cars,analyze its challenges to China's tort law,and investigate the status quo of foreign regulations on self-driving cars,and propose ways to improve China's tort law on harm caused by self-driving cars.This paper is divided into three chapters.The first chapter is an overview of the self-driving car,mainly introducing the concept of the self-driving car,classification characteristics,as well as the traditional tort liability law in dealing with the plight of the infringement of the self-driving car.This paper starts with the relevant legislation and regulation of self-driving cars in China and the current provisions of tort liability law,and analyzes the shortcomings of tort liability law in dealing with the infringement of self-driving cars,such as the difficulty in identifying the subject of liability of self-driving cars,the application of tort liability of fault and the dilemma of the application of product liability.The second chapter is the investigation of the tort laws and regulations in foreign countries.This sectionr introduces and analyzes the relevant legislation of self-driving cars in Germany,the United States and the United Kingdom,and analyzes the above national legislation example to our country self-driving car legislation enlightenment.The third chapter is the system thought of tort liability of self-driving cars.First of all,the paper puts forward the construction ideas of automatic tort liability,including distinguishing different levels of autonomous driving,distinguishing different liability subjects and proposing the construction ideas of tort liability of self-driving cars.Secondly,analyze the responsibility under different reasons automatically.Finally,the regulation and insurance of self-driving cars are proposed.
