In this paper,it was evaluated for the advantages and disadvantages of the developed countries and developing countries(including China)in protection of disabled persons' right to education through international law.It was used by Literature review, policy analysis and comparative law to analyze and compare the relevant theories for disabled persons' right to education in different countries. It based on the basic theory of the disabled right to education, and the introduction of the international conventions. The paper evaluated the legislative protection in the right to education of the disabled persons in developed countries and developing countries(including China).Especially in the past 10 years,China has done a good job in the protection of the right to education for the disabled. In the end,we need to find out the advantages and disadvantages of China in the field, also to find out more better legislative improvement for Chinese Government. Conclusions are as follows:1.Through the comparative study between the developed countries, the United States is the best in the protection of the right to education for the disabled, which has a reference for my country.2 China has made remarkable achievements in the development of the right to education for the disabled in the past 10 years. There is still a certain shortage if we compared with the developed countries.China is in the leading position if wecompared with other developing countries,3 After 2006,China has achieved great achievements in the education and protection of the disabled in the short time through the education and protection of the disabled by the government, which is more suitable for the actual conditions of China.4 Most countries have accepted the new concept of the disabled--equalization.In my country,we have the law "protection law of the disabled".But more normal people are still a sense of sympathy, there is still lack of equalization.
