Research On Forestry Administrative Law Enforcement

With the advancement of the rule of law in the environment and the establishment of an ecological civilization,in recent years,China continues to increase its efforts in promoting forestry legislation,regulating the functions of the forestry authorities,deepening the reform of the forestry administrative law enforcement system,and strengthening the concept of the rule of law in forestry.It can be seen that scientific and effective construction of the forestry administrative law enforcement system is an inevitable requirement for the development of forestry science,an important guarantee for the sustainable development of forestry,and an objective requirement for building a beautiful China.However,focusing on the operational status of China's forestry administrative law enforcement work,the "Forest Law" has not been amended for many years,and many forestry laws have not been adapted to the actual needs of current forestry administrative law enforcement work.Moreover,the institutional disadvantages of the combined government and business are becoming increasingly prominent,lack of professional quality of law enforcement officers and lack of unified management throughout the entire process,all of the above issues have greatly hindered the scientific process of forestry management in China.Therefore,it is a long-term and imminent task to conduct research on forestry administrative law enforcement to help them reform.The study of this topic starts with determining the relevant concepts of forestry administrative law enforcement,clarifies the relationship between administrative law enforcement and forestry administrative law enforcement,and summarizes the nature of forestry administrative law enforcement.The specific nature includes legality,mandatory,initiative,long-term and public welfare.Sources of the nature have inherited from administrative law enforcement,and also have the characteristics that forestry administrative enforcement is different from other administrative enforcement actions.Based on the related concepts,this paper takes the research results of forestry administrative law enforcement as a pre-research basis,combines the results of expert discussions,field visits,and literature research,and summarizes the current problems in the implementation of forestry law enforcement.The problems mainly concern four aspects:the legal basis for law enforcement,the personnel for law enforcement,the procedures for law enforcement,and the supervision of law enforcement.The purpose of asking the questions in the front is to analyze the causes of the problems and propose solutions to the problems.After that,by analyzing this question,the main reasons are:the legislative time of forestry laws was earlier and there was a lack of amendments to the contents of forestry administrative enforcement in recent years,the authorization of administrative law enforcement of forestry administrative enforcement subjects is vague,the lack of understanding of the importance of forestry administrative law enforcement personnel by the forestry authorities,China lacks special laws to regulate administrative procedures,the subject of forestry administrative law enforcement attaches less importance to the supervision of administrative law enforcement,etc.Finally,this issue integrates the requirements of the era of China's forestry administrative law enforcement and the current state of the rule of law,and proposes corresponding countermeasures for the problems existing in forestry administrative law enforcement.A total of four countermeasures to solve the problem.First,to perfect the current forestry legal system through legislation,increasing the illegal costs of forestry violations and paying attention to grassroots research prior to legislative amendments.Second,standardize the main body of forestry administrative law enforcement by reforming the management model of the main body of forestry administrative law enforcement,improving the qualification requirements of forestry administrative law enforcement entities and law enforcement personnel,and implementing the records of the entire process of practicing the forestry administrative law enforcement personnel.Third,strict forestry administrative law enforcement procedures are established through the formulation and introduction of administrative procedure codes and a sound accountability system for procedural violations.Fourth,strengthen supervision over forestry administrative law enforcement by improving supervision mechanisms for forestry administrative enforcement,strengthening public awareness of supervision and accountability,paying attention to administrative reconsideration and administrative litigation,and jointly supervising law enforcement agencies.
