Legal Regulation Of Freedom Of Expression In The Age Of Media

From the "rule by twitter" firstly developed by Donald Trump,the incumbent president of the America,to Beijing Times which ranks among Top 100 throughout the world in circulation stopped publication since 2017 due to heavy losses,plus CCTV and the People's Daily's participation in live platforms,all these are definitely promoting the reform of traditional media.With the beginning of we media era of the whole people,more and more people receive information through electronic terminals,and we media is becoming an important platform for people to express and exchange their views.We Media,represented by social softwares such as blog,Weibo and WeChat,as a newborn in the Internet era,has changed the thinking and pattern of information exchange,provided more channels for the exercise of the right of free speech,and made everyone a spreader of information.Social contact means interaction and media means information.We media fully shows the fusion of social contact and media,combining immediacy,intercommunity and openness,which provides a brand-new form of free expression and greatly enhances the people's awareness of obtaining public information and ability of expression,and plays an active role in individual development and the formation and perfection of democratic society.However,the convenience conceals a lot of danger and brings about reckless effects.It is unavoidable that new technology may bring about a series of adverse effects,causing legal issues arising day by day,which fails to fully protect the legal civic right of free expression.Thus legitimate and effective legal regulation is badly needed.The different values of civic right of privacy,right of reputation and so on are inclined to keep a balance with the public right of free expression in the traditional media era,but such balance may be broken or even become unbalanced with the development of we media era.There is no absolute freedom in the world,only relative freedom.Therefore,the legal regulation conducted on the free expression in we media era can fulfill the civic right of free expression,and help people use we media in a better manner.Therefore,the paper firstly introduces the basic conception of we media and free expression,discussing the value of free expression under we media era from three aspects,namely,to promote the course of political democracy,to propel stable development of the society and to facilitate the realization of personal value.By combining with the overall background of we media era.the paper secondly analyzes the necessity of legal regulation on free expression in we media era in our nation from three perspectives,namely,state security,public order and individual rights.Thirdly,it collects and analyzes the current situation of legal regulation on free expression in we media era,and concludes and summarizes the existing problems from four aspects,namely,legislation,government regulation,self-regulation of we media industry and civic awareness.By analyzing the Internet regulation pattern in some representative countries like Germany,Singapore,the United States of America and Britain,the paper summarizes the characteristics of legal regulation in foreign countries on free expression in we media era so as to explore and learn from the successful experience.On the basis of above discussions and analyses,the paper further states the specific countermeasures for perfecting the legal regulation on free expression in we media era,and explores the legal regulation suitable for China's national condition,namely,to perfect relevant legislation,to set up the principle of government regulation,to establish supervision mechanism,to lead the self-regulation of we media industry,to improve and perfect the convention and regulations for self-regulation of the industry,to make full use of self-regulation of the industry,to enhance the legal awareness of citizens,to cultivate the civic consciousness of self-discipline,and to form reasonable countermeasures and opinions,so as to better promote the exercise of right of free expression in we media era and the development of society under the rule of law.
