The online gaming industry is currently one of fastest growing entertainment industries around the world,especially in the last two years.It is not only enriches people's life,but also brings new challenge to our traditional copyright law.Therefore,how to protect the rights related to live online game through the law has become a common topic in the jurisprudential circles and academic.The current laws have made more complete regulations on the copyright of data code,while the protection of live broadcast screen is blurred.In fact,there are more disputes in the picture Online Games.And the following issues comes a series of dispute:Whether the online game picture itself belongs to the object of copyright law,whether the online game picture formed by the player is original,whether the live online game can use "Fair use",whether the live online game picture can be protected by copyright law and so many other challenges.These problems are due to the fact that our traditional copyright is not adapted to the new technology,and that many of the copyright owners make the ownership is not clear.For the balance of interests which between the online game developers,live online game platform,players,and other relevant persons,the author hopes to put forward some new ideas by studying regulations and cases,in order to promote sound development of the online game industry and cultural transmission.the author firstly explains the conception of "works" in copyright,and demonstrates that pictures on live online games belongs to "works" in copyright law.Then comparatively analyzes The advantages and disadvantages of different protection paths of online game works.After this basic research,the author analyzes the current situation and difficulties of the copyright ownership of the picture in live online games,and proposes"cooperative work" and "collective management of copyright" to solve the problem,In the end,the author considers it applicable if copyright collective management organization can exercise the corresponding rights,so that promote sound development of the online game industry and ensure fair distribution of interests,and also realize the original intention of the establishment of copyright law.
