Primary Exploration For Improvement Of Government Power List System

The natural expansion of administrative power requires us to restrict it,and the implementation of the power list system is a new way to control and restrict the administrative power.The implementation of power list not only is beneficial to strengthen the social supervision of administrative power,but also avail to perfect the internal supervision mechanism of administrative organs,make clear the exercise scope of administrative organs,and better protect the legitimate rights and interests of social masses.This article combines theories with practices,and the two main lines of theory and practice exist through the whole text.This paper composes of four parts,including introduction part which presents the background and significance of the subject,current situation of the study and the ideas of this paper,the structure and research methods of this article,as well as innovation and deficiencies.The first part of article introduces the general theory knowledge of power list,which separates the power list into two words including power and list.Then it presents every content of power list and further anylize them one by one in order to understand the system of power list.At last,it introduces the original intention of the design of power list,which lays a solid theoretical foundation to thoroughly understand the system of power list.Based on the second part of the theories,the author takes the implementation of the power list of Local Tax Bureau at Anhui Province as a breakthrough point,and briefly describes an overview about the implementation of power list and the scientific method adopted by Local Tax Bureau of Anhui Province during the process of teasing power list.All of these are worthy of our affirmation and recognition.But there are always two sides to things,especially new things.We should also see the problems when we achieve the phased objectives.During the process of teasing the power list of Local Tax Bureau of Anhui Province and other Local Tax Bureaus,through the comparison and analysis,we can conclude that three main problems are there:the conflicts between the existence of power list and the government duties and powers prescribed by law,the unclear classification of power list,and the unperfection of restriction mechanism matching with power list.The emergence of this series of problems makes that the initial goal of the power list system can not be realized,which is not conducive to the construction of a nomocracy country and the maintenance of people's rights and interests.The third part of this paper is about the goals and principals of improving power list system,and after the brief introduction of the goals,then it figures out the basic principles to originally perfect the power list system,which means statutory powers principle,due process principle and the equality of right and responsibility lay the principle foundation to further study and perfect the power list.The fourth part of this paper based on the second part and the third part makes the corresponding basic principle of administrative law through the whole paper,and presents the path selection for solving the problems which suits the remedy to the case.It means perfecting administrative organic laws and related legal regulations,implementation of standardized management,setting up a dynamic adjustment mechanism and reinforcing supplementary protection mechanisms for the power list system further promote the perfect of power list system,which is quite meanful to develop the system of scientific design and efficient way of practice.
