The Establishment Of Institutions Shall Be Legalized Through The Power And Responsibility List Ststem

"Institutionalization" is an important guarantee for deepening the institutional reform of the party and the state.The decision of the CPC central committee on deepening the reform of party and state institutions proposes to manage all kinds of organizations and institutions according to law,and speed up the legalization of institutions,functions,authorities,procedures and responsibilities.We will strengthen the seriousness and authority of the "three determinations" regulations,fully implement the system of government departments' power and responsibility lists,and ensure that these lists are in line with the "three determinations" regulations,Standardize and restrain the performance of duties,so that power can run in the sun.So promoting the connection between the power and responsibility list and the three determinations is an important and a powerful measure to promote institutionalization.The power and responsibility list system has many years of practical experience and theoretical summary in China,so it has lots of advantages to promote the institutionalization: first,the power and responsibility list system is designed to standardize and constraint the actions of the government,it has the same purpose with the institutionalization;Secondly,The power and responsibility list can be effectively connected with the "three determinations".In view of the problem such as division of responsibility between departments unclear and lack of accountability mechanism which occurred in the “three determinations”,the power and responsibility list system can solved it well;Thirdly,from the perspective of the institutional text of the power and responsibility list,power and responsibility list has gained the support of the party and state policies and documents as an important tool of establishments of legal implementation,the "decision" points out that the accrual list fully implementing the government system,build relationship between the power and responsibility and three determinations,Restrain the performance of duty,let the power to run in the sun.However,there are also some problems besides the advantages.The current system of power and responsibility list has some problems,such as the question of the suitability of the compilation subject,the lack of unified regulation of the compilation content,the lack of standardization of the compilation basis,and the inconsistency between the compilation procedure and the due process,those problems had to be solved first.In addition,because the power and responsibility has two types,so some scholars have questioned the inadequacy of cohesion between the power list and the responsibility list,which impeded the implementation of the power and responsibility list system.Therefore,from four perspectives: subject,content,basis,procedures to refine the list of responsibilities and power,reinforcing the cohesion between power list and responsibility list,makeit accord with the need of institution establishment legalization,so promoting the realization of the institutionalization better and faster.
