Study On The Knowledge Of Law In The Northern Dynasties

The Northern Dynasties was an important historical stage during the transition from the Wei and Jin Dynasties to the Sui and Tang Dynasties.In the legal system,it laid the foundation for the legal system of the Sui and Tang dynasties and later generations,and the knowledge of law which behind the legal system has also made great achievements and has profoundly affected the development of Sui and Tang Dynasties.However,when the scholars were studying the Northern Dynasties,they mostly focused on the legal system,seldom involved the study of the knowledge of law in Northern Dynasties.When after studying,it can be found that the achievements of the knowledge of law in Northern Dynasties are not inferior to the legal system.,and its content is rich.Compared with other disciplines,the characteristics of the knowledge of law in Northern Dynasties are extremely clear and have high research value.The purpose of this paper is mainly to sort through the main aspects of the knowledge of law in Northern Dynasties,to enhance the understanding of it and to understand the true features of it.In addition to the introduction and conclusion,the text is divided into four parts.The first part mainly sorts out the development of the knowledge of law in the Northern Dynasties.Firstly,it gives a brief introduction to the background and development of the knowledge of law in the Northern Dynasties.Then it discusses the development of the knowledge of law in the Northern Dynasties in Northern Wei Dynasty,Eastern Wei and Northern Qi Dynasty,Western Wei and Northern Zhou Dynasty respectively.The legislative and judicial achievements of the person who studies the law are the entry point to understand the impetus of the people behind the development of the Northern Law.The second part gives a detailed introduction to the content of Northern Law,it mainly involving the definition of legal concepts,the study of legal regulations,and the discussion of difficult cases.This is the legal science as the law of ancient Chinese society and the main content to be explored.Through the analysis of the opinions expressed by those who researched the law at that time on the relevant contents and specific cases,the concrete results of the development of the Northern Law at that time were summed up and concluded,so that there was an intuitive understanding of the Northern Law.The third part summarizes the three characteristics of the knowledge of law in northern dynasties by comparing with the knowledge of law in Han Dynasty,Wei Dynasty,Jin Dynasty and the Southern Dynasties.First,Confucianism has a strong ethical background.The Northern Dynasty was in an important stage of legal Confucianism.Its law was greatly influenced by Confucianism.The second is the fusion of multi-source legal culture.The Northern Law has been influenced by specific environmental backgrounds.It has combined the culture of Central Plains,Hexi and Jiang Zuo to study law.Thirdly,there are many families of legal researchers.The family of legal scholars in the Northern Dynasties was far ahead of other periods,including the Cui's family from Qinghe,the Feng's family from Bohai,and the Gao's family from Bohai.It was precisely because of the promotion of the family of legal scholars that the knowledge of law in northern dynasties could have such a great influence.The fourth part introduces the influence of the knowledge of law in northern dynasties on the time and the Sui Dynasty.The impact on the time was mainly from three aspects: the legal form,the law compilation and the legal system,demonstrating the specific influence of the knowledge of law at that time.The influence on the Sui Dynasty was mainly based on people who were studying law,Using the people of the law as the medium,through the introduction of the legislative and judicial activities in which they participate in,to understand the influence of the knowledge of law in the Northern Dynasties at the time.
