Prevention And Control Of The Telecom Fraud Crime In The View Of The Crime Triangle Pattern

As a new type of fraud,the telecom fraud has been rising in recent years,and in2017,the number of cases of telecom fraud in the national public security system is537,000,and the number of cases has been higher in criminal cases,and the number of cases of fraud in telecom network was 78,000,up 55.2% from the same period last year.Both also showed a trend of growing speed,and followed the crowd throughout all levels of criminal victimization,do more harm to the social economic order,and personal information security brings great hidden trouble to people.However,because of the crime,telecom fraud crime with the occult,cause the crime is difficult to collect evidence,and difficulty under the jurisdiction of the crime,the traditional way is difficult to fundamentally solve the problem of the high crime rate.And more focused on research of to this kind of crime punishment law perspective,or from a particular aspects of crime,for this kind of telecom fraud crime against the lack of theoretical guidance,therefore,need from a new perspective of criminology theory to look for other ways to telecom fraud crime prevention and control.The theory of crime triangle pattern pays attention to the motive of crime,the condition of crime and the ability of crime,and has a good degree of cooperation in the prevention and control of such crimes.Based on the analysis of the formation and development background of telecom fraud crime and the development situation,this paper proposes the significance and purpose of the research on the prevention and control of telecom fraud.First of all,we should make a macro grasp of telecom fraud crime,distinguish between the crime of telecom fraud and fraud,understand the current situation of the theoretical research on the prevention and control of telecom fraud crime,and summarize the behavioral characteristics of telecom fraud crime from the aspects of the way of crime,the collection of criminal evidence,the crime area and the response of the victim.Secondly,this paper analyzes the predicament of the prevention and control of telecom fraud crime prevention and control,and discusses mainly from theinvestigation organ,financial payment system,social responsibility of crime prevention and control,and law enforcement.Thirdly,the author analyzes the behavior pattern of telecom fraud crime,mainly from the background of behavior,analyzes the interests of crime,studies the layout of criminal organization,and the anti-investigation thinking of the criminal.Fourthly,this paper analyzes the theoretical choice of the prevention and control of telecom fraud crime,analyzes the typology characteristics of telecom fraud crime,introduces the theory of crime triangle pattern on this basis,and discusses the implications of this theory on the prevention and control of telecom fraud crime from the aspect of controlling criminal conditions and restricting the ability of crime.Fifth,with the help of the theory of triangle pattern of crime,this paper starts from the three elements of this theory,proposes suggestions on the prevention and control of the current telecom fraud crime,and forms an effective prevention and control theory system by improving relevant laws and regulations,strengthening social management,changing the law enforcement concept of public security organs,new technologies and new methods,so as to reduce the crime rate of telecom fraud.
