Currently,countries along the road cover the destination countries of most China international travelers.And the civil aviation is the first priority for international passengers,huge amounts of flights will inevitably lead to aviation accidents,which will involve international air transport liability rules and liability of third party damage caused by foreign aircraft.Besides,the rapid development of the air transport will increase the demand for civil aircraft in the countries along the road,which involve aircraft rights.Therefore,on the basis of improving domestic legislation,China should combine the initiative to promote global governance with regional legal cooperation.The main body of the paper consists of three chapters except introduction and conclusion:The first part is mainly to make a brief introduction on the international air transport carrier liability rules of the “Warsaw System” and the 1999 Montreal Convention.Through the brief,the most important aspects of the liability rule are shown to be the liability limit and attribution principle.The second part focuses on the liability limit and principle of liability identification.Based on the previous chapter,the horizontal analysis of these two aspects is emphasized.First,with the development of society,it is necessary to study on if the liability limit is rational.Second,two-tier system which established by the1999 Montreal Convention has the advantage of the existed liability principle.The third part contains domestic law and international law two aspects.The first chapter is about improvement of the domestic law,based on the analysis of the above mentioned parts.As for international law,it is proposed to make full use of the "Belt and Road Initiative" to provide more effective ways for the development of international aviation private law.
