Research On Administrative Regulations Risk Assessment System

China is in a critical period of administrative system reform.However,the process of reform of administrative regulations is relatively slow.Administrative regulations concern the vital interests of the public.The assessment of the risk of administrative regulations is an important issue that needs to be solved urgently.The risk assessment of administrative regulations is helps reduce decision-making mistakes and improve the quality of legislation;helps protect the rights of citizens and prevents the abuse of administrative power;and help-build a government of the rule of law and a society ruled by law.Based on the status of the risk of administrative regulations and the implementation of assessments in various regions,this article adopts literature research methods and case analysis methods to conduct research,summarize law experience,and identify problems,so as to provide suggestions for advancing the risk assessment of administrative regulations and reducing the risk of administrative regulations..In recent years,the number of administrative cases has continued to increase,and the areas of administrative disputes have mainly focused on urban construction and public security.Violent demolition,violence against law,urban management and law enforcement are hot words in recent years.Administrative agencies have caused administrative disputes in their enforcement process because of their own behavior and the uncooperative behavior of administrative counterparts.Although various regions have successively issued regulations for the evaluation of administrative regulations,there are problems with poor operations and formalities in the implementation process,which have exacerbated the risk of administrative regulations.The reasons include: law enforcement officers have their own ideas and concepts,lack of risk awareness,official-oriented,command thinking,self-discipline awareness,poor self-control awareness can easily lead to conflict between the executive and administrative counterparts;administrative regulations themselves the existence of flaws,improper allocation of rights and obligations,but also easily lead to administrative disputes;social public awareness of the improvement of the legal system,but the concept of rights and obligations is not completely correct,does not cooperate with administrative staff of law enforcement,but also led to administrative disputes;the lags in the risk assessment and supervision of regulations and regulations,and the lack of oversight on the part of the administrative agencies themselves havecertain deficiencies and are prone to trigger administrative disputes and create administrative regulations risks.The existence of administrative regulations risks may damage the rights of the public.To minimize the occurrence of risks,it is necessary to assess the risks of administrative regulations.First of all,it is necessary to strengthen the risk perception of the staff of administrative agencies,establish risk awareness,service awareness,fairness awareness,self-control awareness,and truly start from the administrative staff themselves to guard against the risk of administrative regulations.Secondly,because administrative regulations may have flaws in their own right,when assessing the risks of administrative regulations,it is necessary to follow different stages,before,during,and afterwards.During the evaluation,a strict evaluation index system must be established.The focus of evaluation indicators is different.Third,we must standardize the procedures for risk evaluation of administrative regulations and strictly follow the procedures.Finally,the exercise of any power must be supervised,and the assessment of the risk of administrative regulations is no exception.Only by strengthening supervision over administrative regulations and supervising risk assessment can we ensure that the rules are scientific and reasonable and protect the legitimate rights and interests of citizens.Including the internal supervision of the executive authorities,we must also pay attention to public supervision.
