Study On The Legal Protection Of Farmers' Rights In The Rural Land Circulation

With the economic development and the release of opinions separating three rights that “Ensure the ownership rights,stabilize the contract right,free the management right”,new round of rural land circulation is on the rise around our country,which is the job of adapting to the development of rural productivity.New business subjects access to agriculture,which promote actively the development of productivity and provides the new drivers powering modern agricultural development.With the new business subjects introducing,it makes rural land circulation in a new environment,but also brings new issues.Due to the lack of legal awareness and less standard of the circulation contract etc,the farmers' rights cannot be ensured effectively and infringement of farmers' rights often occur,such as the phenomenon of “Break contract,Abandon land” took place in Shandong and Hebei,which infringe farmers' right seriously.Therefore,all these realistic issues deserves our study that improve rural land circulation mechanism,protect farmers' rights and solve the issues that encountered in the process of land circulation,to promote the structural adjustment of rural industries,increase the utilization rate,improve farmers' income level and living conditions,speed up the establishment of rural industrialization and urbanization.With the deep development of rural land circulation,domestic scholars gain wider experiences for the study of the rural land circulation policy,with comparative mature research methods and practices.Whereas,there is less study in protecting farmers' rights in the process of land circulation,much more studies are focus on the cause,role and influence of the rural land circulation.This paper studies the protections of farmers' rights through the event of “Break contract,abandon land” that frequently occurred recently based on current situation of rural land circulation.
