Research On The Agriculture-related Duty Crimes

With a history of thousands of years,China is a vast agricultural country.Nowadays,our country's economy has gain great development,issues of agriculture,farmer and rural area are closely related to the economic development and social stability of our nation.Especially since the strategic target of constructing socialistic new countryside has been proposed,our country has increased the financial input to agriculture,rural areas and farmers,and relevant supportive policies have been strengthened.While increasing the financial investment in the "three rural" project,what we cannot ignore is the duty crimes related to the farmers,which has spread to rural areas.It not only violates farmers' interests,but also influences the construction of new socialist countryside and social harmony.Therefore,this paper aims at the status quo of duty crimes in the agriculture beneficial area by empirical research.Through analyzing the influential factors of agriculture-related crimes,exploring the targeted,operational precaution strategies is significant in theory and reality.It hopes to provide reference opinions for H City to curb agriculture-related duty crimes,and to make effective contributions to contain and reduce the agricultural job-related crimes,so that the nation's policy of supporting agriculture and benefiting farmers can benefit the peasant masses.The author conducts research on this article by using literature research methods,empirical research methods and case analysis methods,analyzing from the following research ideas.Firstly,the concept of duty crimes and preventions of duty crimes is used as the theory foreshadowing for the ensuing chapters.The author proposes personal understandings,and defines the concept of agriculture-related duty crimes,which has not been defined in the theoretical circle.According to the actual practice of procuratorial work,this essay defines the concept of duty crimes in the field of strengthening agriculture and benefiting farmers.In the meanwhile,it briefly explains the public choice theory,power restriction theory and rent-seeking theory involved in this essay.Secondly,by conducting an empirical study on the situation of agriculture-related duty crimes investigated by the procuratorial organs of H City from 2013 to 2016,the author analyzes the basic situation and characteristics of the agricultural job-related crimes in H City,including the trends in the amount of crimes,the subjects of crime,the distribution of charges,and the areas in which the crimes are concentrated.Thirdly,based on the analysis of the cases concerning agriculture-related duty crimes handled by the procuratorial organs of H City,this essay thoroughly probes into the influential factors concerning the agricultural job-related crimes.From the aspects of thinking,personnel quality,system,laws and regulations,supervision,etc.,the factors which influence the agriculture-related duty crimes are summarized.The influential factors are:from the subjective perspective,firstly,the ideas of "rational economic man"and "power rent-seeking" lead to the proliferation of privilege thoughts,which seek private gain through power,secondly,the overall quality of grassroots cadres is low and their awareness of law is weak,from the objective perspective,firstly,institutional construction is unsound,secondly,laws and regulations are imperfect,thirdly,supervision and restriction are not in place.Finally,based on the influential factors mentioned above,this author proposes several preventive countermeasures.The author explores from the"concept-system-supervisory" preventive model,which is also a kind of preventive mode from subjectivity to objectivity.The author believes that it is necessary to take effective measures to prevent and reduce agriculture-related duty crimes by improving the ideological level and personal qualities of grass-roots cadres,intensifying legal propaganda,strengthening institutional construction,perfecting the law and regulation,strengthening supervision and restriction.
