The Research Of Administrative Law Enforcement In Drunk Driving Checking And Punishment

Drunk driving is recognized as one of the most serious traffic violations around the world.And administrative enforcement of drunk driving is the key work in the government.This article seeks to find out the problem and deficiency within the process of the law enforcement in the drunk driving by manifesting the concept,character,and hazard of automobile traffic violations and drunk driving,then puts forward the countermeasures and legislative proposals for the problems in the investigation and punishment of drunk driving.This article contains three parts.Firstly,the concepts of traffic driving violations in the road traffic management regulation are discussed.By carefully analyzing the character and hazard of drunk driving,the good theory foundation is established.Next,the problem in the law enforcement of drunk driving is discussed.By analyzing the details of the traffic accidents in Shaoxing City,Zhejiang Province,this article points out the necessity and practicability of the research into the investigation and punishment of drunk driving violations.This article discusses the problem of improper or insufficient executors and the disunity of standard in administrative enforcement in the perspectives of subject,object,scope,standard and procedure of administrative enforcement concerning driving after drinking/drunk driving with the checking work carried out through the procedure such as breath test,blood test and the eidentification of vehicle properties.This parts reveals the problems concerning the applicability and improper and ambiguity enforcement of related laws.Finally,this article puts forward the suggestions to improve the administrative enforcement during the drunk driving.Particularly by the use of Internet Plus,technologies in the road traffic enforcement,and formalization qualification and resources by legislation,the laws and regulations can be more suitable to modern situation.In the end,some suggestions from the perspectives of legislation,standard,education,supervision and creation of establishing a thorough,explicit and operability procedure of administrative enforcement of driving after drinking/drunk driving are put forward.
