In recent years,the phenomenon of bullying on campus has become more and more serious.People's concern about bullying in schools is increasing day by day.However,teachers,parents,school bullying victims and victims have little knowledge of the specific meanings of bullying on campus.It is this difference between understanding and reality that makes it difficult to achieve effective results in the governance of bullying on campus.If the school bullying behavior does not violate the criminal law and constitutes a crime,its behavior is only in conformity with the infringement liability.It belongs to the infringement act in the civil law,and has its own characteristics in the responsibility of the behavioral subject.It can be seen that school bullying is not only able to rely on criminal law for governance,but civil governance is also feasible.Looking at domestic and international research,there are relatively few measures to deal with bullying from the civil point of view.Most of the measures are taken from the perspective of criminality and policy.However,criminal governance will inevitably have parts that cannot be covered,and policy governance does not have the force of law.Therefore,it is a very important content that can compensate for the civil governance of these two governance models.Therefore,in order to improve the existing governance methods,this paper attempts to explore the civil governance of bullying on campus.The article starts with the basic concepts,analyzes and demonstrates the constituent elements of the tort liability,and reveals the existing problems through the examination of foreign successful systems and the analysis of the domestic status quo.Finally,in the concept of institutional perfection,we propose to prescribe the content of special infringement,consider the necessity of introducing special procedures for minors in criminal proceedings,and emphasize the important role that social supervision can play in the management of campus bullying.
