Research On The Party's Legal System Construction And Experience In The Early Period Of New China

The great achievements China has made in the construction of the rule of law have not been overnight but have gone through a tortuous process of exploration and development.In the early days of the founding of New China,various undertakings were abolished.The construction of the legal system was undoubtedly one of the most important tasks.The Communist Party of China attached great importance to the building of the legal system and abolished the old legal system for maintaining the Kuomintang's reactionary rule.The first session of the Political Consultative Conference passed the " The Common Program of the Political Consultative Conference of the People's Republic of China,and subsequently formulated the "Constitution of the People's Republic of China" and a series of other laws and regulations.The establishment of a socialist democratic legal system has played an important role in safeguarding and consolidating the new people's political power.It has initially established a new China.The foundation of the socialist legal system has provided valuable historical experience for the exploration and practice of the new China's legal construction in the future.Through reviewing and reflecting on the achievements made since the founding of New China until the establishment of the Chinese Communist Party's legal system in 1956,we summed up the experiences and lessons learned from them and obtained useful revelations for the progress of the Party's leadership in the new era of China's rule of law,in order to build a society with Chinese characteristics.The legal system of the rule of law and the construction of a socialist country under the rule of law are of great significance.The exploration and study of the party's legal system during the early years after the founding of the People's Republic of China was conducive to understanding and grasping the historical process of the party leading China's legal construction and adhering to the Chinese rule of advancing socialist rule of law under the leadership of the Chinese Communist Party.The party-led ad socialist rule of law in China is a historical process.During the great historical process of the construction of new China's rule of law,due to the limitations of history and realityduring the founding of the People's Republic of China,the legal system has achieved certain results and has experienced some twists and turns.Therefore,with the tremendous achievements in the construction of the rule of law and the overall advancement of the rule of law,the review and reflection on the party's legal construction during the early years after the founding of the PRC was conducive to a deeper understanding of and mastery of the party's rule-of-law construction and the construction of the rule of law in the new era.Provide historical experience and inspiration.This article briefly reviews the party's legal construction during the early years of the founding of the People's Republic of China,summarizes and reflects on the legal construction of that specific historical period,explores the historical experience of the party's legal construction,and provides inspiration to contemporary China to advance the rule of law and build a socialist country under the rule of law.The summary and reflection on the historical experience of the legal system construction in the early days of the founding of the People's Republic of China was a difficult point.From a historical point of view,it grasped the necessity of a series of laws and regulations and judicial practice at that time and explored the experiences and lessons in a new era.The significance of research history is to provide experience and inspiration for the construction of the contemporary era,and to avoid historical nihilism due to some minor twists and turns in the past.Through the exploration and reflection on the party's legal construction during the early years after the founding of the People's Republic of China,this article attempts to provide experience and enlightenment for achieving the goal of“building a socialist legal system with Chinese characteristics and building a socialist country under the rule of law” as a rule of law.
