Study On The Process And Basic Experience Of The Communist Party Of China Governing The Country According To Law

This paper is about the study on the process and basic experience of Implementing the rule of law of the Communist Party of China(CPC)from the founding of the CPC in terms of six aspects.It is the initial and establishing stage from the founding of the CPC in 1921 to the eve of the establishing of the People's Republic of China in 1949.Under the leadership of the CPC,the new democratic law system had gone through a process from zero to one,and from fragment to system.The CPC has begun to nurture the idea of governing the country according to law.It is the establish and tortuous development stage from the establishment of the People's Republic of China in 1949 to the third Plenary Session of the 11th CPC Central Committee in 1978.the CPC had explored the socialist construction of the law system,In this period,the CPC accumulated some valuable experiences and profound lessons.In the mean time,the CPC had gathered some democratic and legal conditions for the implementing the rule of lawIt is the eventual establishment stage from the third Plenary Session of the 11th CPC Central Committee in 1978 to the eve of the 16th National Congress of the CPC.:In this period,the socialist law system had been restored and developed,the strategy of implementing the rule of law had gradually formed and finally become the foundamental philosophy of the CPC.From the 16th National Congress of the CPC,the implementing the rule of law has ertered the pursuing and promoting stage.The implementing the rule of law has been improved and perfected in all aspects of the society.Especially after the 18th National Congress of the CPC,the construction of socialist law has gone into the rapid development and the implementing the rule of law has enterd the comprehensive stage,.The implementing the rule of law of the CPC has made the some outstanding achievements and accumulated a number of valuable experiences which have many features and advantages.The unique characteristic and the biggest advantage of the implementing the rule of law is the leadership of the CPC.The system guarantee of the implementing the rule of law is the socialism system with Chinese characteristics.The guiding of the implementing the rule of law is the socialism law theory with Chinese characteristics.The correct way of the implementing the rule of law is the socialism law with Chinese characteristics.The realization path is the rule of law and the rule of virtue.In this paper,there are some thinkings on the implementing the rule of law.There are many problems to resolve,such as the law system,the leadership style of the CPC,the belief in the rule of law of people,the law construction of the CPC,the lack of the effectiveness to the restriction of power and the reform of the judicial system lagging etc.The author will study and analyze the paths of comprehensively implementing the rule of law according to the problems.
