Research On The Legal System Of Financial Transfer Payment In Ethnic Autonomous Areas

After undergoing rapid development,China economy has entered a stage of stable development in general.Country have increasingly attached importance to the sustainable development of the economy,and one of the keys to sustainability is to adopt certain policies to narrow the gap in economic development across various regions.This policy is the financial transfer payment policy.In our country,the level of economic development is relatively backward and the government's financial income is insufficient because the local autonomous areas are in relatively remote areas.Ethnic autonomous areas cannot provide the same public services as developed areas,so the fiscal transfer payment system has become a key way to solve the financial problems of ethnic autonomous areas.However,when the financial transfer payment in China is implemented,there is no law to supervise it.The fiscal policy has obvious instability,which results in the inefficient use of the funds transferred from the national autonomous areas,the abuse of funds on the one hand,and the lack of financial transfer on the one hand.In the current legal system of China,there is no special law for fiscal transfer payment,only in the law of national regional autonomy,budget law and constitution,there are general provisions.There is also no specific measures to ensure the implementation in addition,the fiscal transfer payment law is not reasonable in the content of legislation,slow down the speed of economic development in national autonomous areas,to achieve regional public service equalization in China has adverse effects.Therefore,it is necessary to solve the urgent problem of financial transfer payment in ethnic autonomous areas from the legal point of view.This article from the transfer payment legal perspective,the main research method is through the use of literature research method,comparative method,in view of the current financial transfer payment of fiscal powers and expenditure responsibilities are not matched,the transfer payment standard is not scientific,lack of legal supervision,the author puts forward the corresponding solution.Define thecriteria for the division of financial and expenditure responsibilities.At the same time,we should integrate the current fiscal transfer payment projects,strengthen budgetary co-ordination,and establish a legal system of transfer payment which is in line with China's actual conditions.Establish and improve the legal supervision system of fiscal transfer payment,make the fiscal transfer payment of ethnic autonomous areas more scientific and reasonable,implement more standardized,safeguard the balanced development of regional economy and economic and social stability,promote national unity and achieve common prosperity of all nationalities.This article is composed of five parts.The first part is the introduction,introduces the topics of reason,research significance,research status at home and abroad,using the theory and research methods;the second part,explore the theoretical basis of financial transfer payment in ethnic autonomous areas,to reveal the nature of transfer payment and internal targets;the third part,in-depth analysis of the legal supervision system of the domestic and foreign financial transfer payment,and the difference foreign financial transfer payment system;the fourth part analyzes the problems of local fiscal transfer payment of national autonomy,put forward the feasible solution.
