| Since the reform and opening up,the country’s economy has grown rapidly,urbanization has developed rapidly,and a large number of floating population has flooded into cities.While meeting the needs of social development,major cities are also "overcrowded".However,under the current situation that the prices of existing commercial housing continue to rise and the number of affordable housing is small,most people can only solve the housing needs through renting.However,compared to the booming development of the housing sales market,the housing rental market has been slow to develop,and housing lease disputes have also been reported frequently.The rights and interests of housing tenants cannot be effectively guaranteed.The fact that the housing tenant is limited by factors such as information acquisition,economic level,and market position in the housing leasing relationship makes it impossible for the lessor to be in full equivalence with the lessor in the housing leasing relationship.Coupled with the existing relevant legislation is not perfect,relevant laws and regulations are more concerned about the equal autonomy of the lessor and the lessee,ignoring the reality between the two is not equal.Ultimately,the rights of lessees are not effectively protected.In order to realize the protection of the tenants’ rights and interests,this paper analyzes the disadvantaged position of the tenant of the house,discusses the practical significance and legal value of the protection of the tenant’s rights and interests,and combines the research on the law and system of the relevant housing leasing outside the territory.The relevant recommendations are actually put forward,that is,separate legislation is adopted for housing leases to realize the declaration of legal values;an information service platform is established to make use of new technologies to make up for the lack of equality between the lessor and the lessee,and to further implement the registration and filing system for housing lease contracts;The use of rental restrictions to solve the problem,to achieve the preferential protection of the rights of the tenant of the housing;finally unblock the dispute resolution mechanism to reduce the cost of housing tenants rights protection.Finally achieve a good living goal. |
