Investigation Report Of Shanxi Lawyers Participating In Litigation Cases Related To Law

At present,the petition letters concerned law and suit have gradually increased,and petitioners “believe the letters and calls but not believe the law”,which has greatly challenged the judicial authority.Therefore,the Central Committee of the Political and Law Commission puts forward the exasperation of lawsuit and petition in time,and includes petition concerned law and suit into legal course.On the establishment of settlement and representation of petition letters concerned law and suit participated by lawyer is further issued.It is introduced to give full play to advantages of lawyers' specialization and neutralization,guide petitioners to conduct petition according to law,showing value of the lawyer,the legal professional group,in the petition.It is of great significance to correctly handle contradiction of lodging complaints,and strive to let the masses feel fair and just in every judicial case.Generally speaking,it is still in the initial stage to organize lawyers to participate in petition concerned law and suit.It is very meaning to understand and grasp the progress and existing problems of this work.In this paper,the author summarizes participating effect of lawyers in petition letters concerned law and suit,which shows the preliminary effect of after lawyers' participation,affirms positive role and finds out the existing problems in operation of the system in terms of implementation.At the same time,the reasons are analyzed from legislation,the role of lawyers and setting up of working mechanism.Finally,the author tries to discuss from strengthening legislative protection,refining the work system as well as improving coordination and convergence mechanism,so as to improve disadvantages of lawyers in our province in participating petition letters concerned law and suit,further play the role of system and better establish a perfect long-term mechanism.
