On The Legislative Regulation Of The Election Fraud In China's National People's Congress

Since the end of the 20 th century,there has been a lot of election fraud in China's National People's Congress.On the solution of this problem,both reality and theory reflect the lack of understanding of the election fraud.However,the regulation that the law can play in solving the fraud problem of the National People's Congress has not been effectively realized.There are obvious deficiencies in the legal basis for the regulation of election fraud in China's National People's Congress,which is an important reason why the election fraud of China's National People's Congress cannot get long-term control.The effective governance experience of modern countries and regions on election fraud also shows that legislation is an effective way to promote the political corruption of election fraud by the rule of law.Before the legislative regulation of the election fraud in China's National People's Congress,the necessity of legislation should be first considered,which is to correctly understand the legislative requirements behind it.The legislative needs for the regulation of fraudulent conduct by the National People's Congress consist of four major aspects.Both the guaranteed needs of the fairness of elections and the authenticity of the people's democracy and the realization and protection of the rights of our citizens in political life are expressions of purpose and demand from the perspectives of power and rights.The necessity of the choice of law as an effective means of regulation and the current need for insufficient supply of legislation is an expression of institutional needs.The legislative value-orientation is the subjective reflection of the objective existence of legislation demand,so the establishment of the legislative value-orientation cannot be divorced from the actual demand of legislation.In the regulation of the election fraud in China's National People's Congress,there is a complex value-orientation composed of order,freedom,and justice.The purpose is to provide an effective “good law” basis for the regulation of election fraud in China's National People's Congress.Based on the response to the regulatory requirements for the conduct of election fraud in China's National People's Congress,a legislative design for the “Anti-Election Fraud Act” is proposed.The Anti-Election Fraud Act is a specialized law that regulates the conduct of election fraud with a relatively independent existence value in the current legal system.The enactment of the Anti-Election Fraud Act should fully reflect the value-orientation of legislation,proceeding from the characteristics of China's election fraud,and combining actual domestic and international legislative experiences to make specific content arrangements applicable to China's actual conditions,in order to provide effective legal basis for electoral fraud regulation.
