Practice And Perfect Suggestions Of Criminal Expeditious Procedure

With the abolition of the reeducation and the modification of the criminal law has expanded the scope of the minor criminal cases.In practice,the contradictions between a large number of criminal cases and the few judicial manpower is serious.Since June 2014,the standing committee of the National People's Congress authorized 18 cities such as Beijing and Tianjin to carry out the trial work on criminal expeditious procedure.The pilot cities,have made a series of positive and useful explorations,such as centralized court sessions and special court appearance,so as to realize the intensification and specialization of handling cases.However,through judicial practice,criminal expeditious procedure still faces such problems as narrow application scope,imperfect protection of the rights and interests of suspects and victims and the lag of the hearing pattern.Therefore,this paper hopes to based in China's judicial practice in the existence of the problem of criminal summary procedure and foreign experience,put forward suggestions for the final legislative scientific,accurate and reasonable amendments to the criminal expeditious procedure provides a certain reference value,and provided some suggestions to the judicial organs to improve the halding mechanism of criminal expeditious procedure.This paper is divided into four parts.The first part analyzes and explains the background and significance of the criminal expeditious procedure in our country.The second part introduces the trial implementation of the criminal expeditious procedure and the existing problems.The third part introduce the foreign countries and regions with similar criminal expeditious procedure and Summarizes the establishment for China.The fourth part combined with the problems existing in the practice,in order to give some suggestions for the public security,procuratorate and court to improve the handling mechanism.
